Critical Notice

Wasiyat is an educational and planning tool. It is NOT a substitute for qualified legal counsel or Islamic scholarly guidance. Nothing on this platform constitutes legal advice, a fatwa, or a binding religious ruling. You must consult a qualified estate lawyer and a Shariah scholar before making any estate planning decisions.

1. General Disclaimer

Wasiyat is designed as an educational and estate planning assistance tool for Indian Muslims. The Platform provides informational guidance based on published Islamic jurisprudence and Indian law to help users understand and plan their estate distribution.

  • The Platform does not provide legal advice. No information on this Platform should be construed as legal counsel
  • The Platform does not establish an attorney-client relationship, a scholar-student relationship, or any fiduciary relationship between you and Wasiyat
  • All outputs, including calculations, generated documents, and AI advisory responses, are for educational and informational purposes only
  • Real-world estate planning involves complex legal, financial, and religious considerations that require professional human judgment

2. Islamic Law Disclaimer

This Platform Does NOT Issue Fatwas

A fatwa is a formal Islamic legal ruling that can only be issued by a qualified mujtahid or mufti. Wasiyat is a software platform and has no authority or qualification to issue fatwas or religious rulings.

  • All Islamic inheritance calculations are based on published scholarly interpretations of the Quran and Sunnah as codified in classical Islamic jurisprudence texts
  • The calculations present scholarly consensus positions (ijma) where they exist, and note areas of scholarly difference (ikhtilaf) where applicable
  • Islamic inheritance law (ilm al-faraid) is a complex discipline with centuries of scholarly discussion. The Platform cannot capture every nuance, exception, or scholarly opinion
  • Users must consult a qualified Shariah scholar familiar with their specific doctrine to verify the applicability of any calculation to their particular circumstances
  • The Platform does not make judgments about the religious validity of any particular family arrangement or financial structure

3. Doctrine Variations

Wasiyat supports five Islamic doctrines (madhahib), each with distinct rules for inheritance calculation:

Doctrine (Madhhab)Key Distinctions
HanafiDifferent rules for grandfather-sibling interaction, specific treatment of distant kindred (dhawu al-arham)
Shafi'iDistinct approach to radd (redistribution of residue), specific conditions for heir exclusion
MalikiUnique rules for joint property (amal), specific treatment of wasiyyah (bequests) to heirs
HanbaliDifferent rules for awl (proportional reduction), specific conditions for distant relatives
Ja'fariSignificantly different inheritance structure, no awl or radd in the same manner, different heir classifications

These are only some of the differences between doctrines. Each doctrine has extensive scholarly literature and internal variations. The Platform implements mainstream positions within each doctrine, but scholarly opinions may vary. Selecting the correct doctrine for your family is essential, and a qualified scholar can help you determine which applies to your situation.

4. Calculation Accuracy

Our inheritance calculations are deterministic and rule-based. Given the same inputs, the engine will always produce the same outputs. However:

  • Calculations are only as accurate as the information you provide. Incomplete or incorrect family or financial data will produce inaccurate results
  • Real-world inheritance situations may involve complexities not fully modeled by the Platform, including contested relationships, missing heirs, undisclosed assets, cross-border assets, and debts of uncertain validity
  • The Platform handles standard and common inheritance scenarios. Extremely unusual family configurations or edge cases may not be fully supported
  • Asset valuations are based on the figures you provide. The Platform does not perform independent appraisals or verify market values
  • The Platform does not account for tax implications, capital gains, or other financial considerations that may affect actual inheritance distributions

5. Professional Advice

Always Seek Professional Guidance

Before executing any estate plan, will, or inheritance distribution based on this Platform's output, you should consult both:

  1. A qualified estate lawyer licensed to practice in your state of residence (Karnataka, Kerala, Tamil Nadu, Telangana, or Andhra Pradesh) who is familiar with Muslim personal law as applied in India
  2. A qualified Shariah scholar knowledgeable in your specific doctrine (Hanafi, Shafi'i, Maliki, Hanbali, or Ja'fari) who can provide religious guidance on your particular circumstances

Wasiyat offers a professional referral network (available on select plans) to help connect you with vetted professionals, but we do not endorse, guarantee, or assume responsibility for the advice provided by any referred professional.

6. ORIS AI Advisory Disclaimer

ORIS (Our Reasoning and Insight System) is an AI-powered advisory feature integrated into the Platform and powered by Anthropic Claude. Regarding ORIS:

  • ORIS provides advisory information only. Its responses are generated by artificial intelligence and are not reviewed by human scholars or lawyers before being presented to you
  • ORIS may produce inaccurate, incomplete, or misleading information. AI systems can hallucinate facts, misapply rules, or generate plausible-sounding but incorrect analysis
  • ORIS does NOT issue religious rulings, fatwas, or legal opinions. It cannot replace the judgment of qualified human scholars or lawyers
  • ORIS responses should be treated as a starting point for research, not as definitive answers. Always verify ORIS outputs with qualified professionals
  • The AI model may not be aware of the latest legal changes, scholarly opinions, or regulatory updates
  • Wasiyat is not liable for any decisions made or actions taken based on ORIS advisory outputs

7. Indian Law & Regulatory Framework

Islamic estate planning in India operates within a complex legal framework. Users should be aware of the following:

  • The Muslim Personal Law (Shariat) Application Act, 1937 governs the application of Islamic personal law to Indian Muslims in matters of inheritance, succession, and wills. However, its application and interpretation may vary
  • The Indian Succession Act, 1925 may apply in certain circumstances, particularly for testamentary succession and probate proceedings
  • Estate execution (obtaining probate, letters of administration, succession certificates) is subject to state-specific laws and procedures
  • Property laws, registration requirements, and stamp duties vary by state and may affect the practical execution of an inheritance distribution
  • Tax implications (capital gains, income tax on inherited assets) are governed by the Income Tax Act, 1961 and related rules, which are beyond the scope of this Platform
  • The Platform provides general guidance based on these laws but cannot account for all jurisdictional nuances, court interpretations, or recent amendments

8. Document Validity

Regarding documents generated by the Platform:

  • Wasiyat does NOT guarantee the legal validity, enforceability, or admissibility of any generated documents, including will drafts, inheritance summaries, and distribution reports
  • Generated documents are drafts and templates intended to serve as a starting point for professional review. They are not final legal instruments
  • A valid will under Indian law may require specific formalities (witnesses, attestation, registration) that the Platform cannot fulfill. A qualified lawyer must ensure these requirements are met
  • The Platform does not register documents with any government authority or notarize any content
  • Changes in law, family circumstances, or asset holdings may render previously generated documents outdated or invalid

9. User Responsibility

As a user of Wasiyat, you are responsible for:

  • Providing accurate information: Entering correct and complete family relationships, asset values, liability amounts, and other data. Inaccurate input will produce inaccurate calculations
  • Verifying all outputs: Independently reviewing and verifying all calculations, documents, and AI advisory responses before relying on them
  • Seeking professional review: Consulting qualified legal and religious professionals before executing any estate plan
  • Keeping information current: Updating your family, asset, and liability information as circumstances change (births, deaths, marriages, divorces, acquisitions, disposals)
  • Understanding limitations: Recognizing that this Platform is a tool to assist with planning, not a replacement for professional judgment
  • Selecting the correct doctrine: Choosing the Islamic doctrine appropriate for your family. If unsure, consult a Shariah scholar before proceeding

10. State-Specific Considerations

Wasiyat currently supports users in five Indian states. Laws governing estate execution, property transfer, and succession procedures vary by state:

StateKey Considerations
Karnataka (KA)State-specific property registration procedures, stamp duty rates, and succession certificate requirements through district courts
Kerala (KL)Unique historical context with Mappila succession customs, state registration procedures, and specific court jurisdictions for succession matters
