What is a Waqf in Islamic law?
A Waqf is a permanent charitable endowment: you dedicate an asset (land, property, or a financial instrument) so that its principal can never be sold, inherited, or otherwise disposed of. Only the income the asset generates is distributed, to the purpose or beneficiaries you name, indefinitely.
Is a Waqf part of my estate for inheritance purposes?
No. Once dedicated, a Waqf's principal is permanently removed from your estate — it is not distributed among your heirs under Faraid, and Wasiyat tracks it separately from your inheritance calculation for exactly this reason.
Can I create a Waqf for my own family (family Waqf)?
Yes. A family Waqf (Waqf-alal-aulad) dedicates income to your own descendants rather than an external charitable cause, and is recognized as a valid Waqf purpose alongside education, healthcare, and religious institutions.
Do I need a lawyer to set up a Waqf in India?
Wasiyat generates the Waqf declaration as part of your document pack, but Waqf property in India can also fall under the jurisdiction of the relevant State Waqf Board depending on the asset and purpose. For registration and compliance with the Waqf Act, consult a lawyer familiar with Waqf administration in your state.
Can I change the trustees or beneficiaries later?
Yes. Update trustee and beneficiary details from your Wasiyat account at any time; the change is reflected in your document pack and in the Waqf's ongoing income-tracking record.
