Terms of Service

These Terms of Service ("Terms") govern your access to and use of Wasiyat, a product of Khair Labs Private Limited ("the Company," "we," "us," or "our"), an Islamic estate planning software-as-a-service platform. By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Service Description
Wasiyat provides the following services:
- Islamic Inheritance Calculations: Deterministic, rule-based calculations of inheritance shares according to five Islamic doctrines (Hanafi, Shafi'i, Maliki, Hanbali, and Ja'fari)
- Document Generation: Automated generation of estate planning documents including will drafts, inheritance summaries, and distribution reports
- AI Advisory (ORIS): An AI-powered advisory feature that provides informational guidance on Islamic estate planning topics, powered by Anthropic Claude
- Encrypted Vault: Secure, AES-256-GCM encrypted storage for estate planning documents, notes, and instructions
- Family Tree Builder: Tools for mapping family relationships relevant to Islamic inheritance rules
- Professional Referral Network: Access to vetted estate lawyers and Shariah scholars for professional consultations (available on select plans)
2. Eligibility
To use Wasiyat, you must:
- Be at least 18 years of age
- Be a resident of India
- The Platform supports users residing in all states and union territories of India
- Have the legal capacity to enter into a binding agreement under applicable Indian law
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials, including your password
- We strongly recommend enabling multi-factor authentication (MFA) for additional account security
- You are responsible for all activities that occur under your account. Notify us immediately at security@wasiyat.in if you suspect unauthorized access
- You must provide accurate and complete information when creating your account and keep it up to date
- You may not share your account or allow others to access your account. Each subscription is for a single user (except the Vault Family plan, which permits designated family member access)
4. Subscription Terms
4.1 Plans & Pricing
Wasiyat is offered under three annual subscription tiers:

4.2 Billing & Auto-Renewal
- All subscriptions are billed annually via Razorpay
- Subscriptions auto-renew at the end of each billing period unless cancelled at least 7 days before the renewal date
- Prices are in Indian Rupees (INR) and inclusive of applicable taxes as per Indian tax law
4.3 Cancellation
- You may cancel your subscription at any time from your account settings
- Upon cancellation, you retain access to the Platform until the end of your current billing period
- After your subscription expires, your data will be retained in a read-only state for 12 months. See our Refund Policy for details on refund eligibility
5. Acceptable Use
You agree to use Wasiyat only for:
- Personal Islamic estate planning purposes for yourself and your family
You agree not to:
- Use the Platform for commercial purposes, including reselling calculations, redistributing generated documents, or offering services to third parties
- Attempt to reverse-engineer, decompile, or extract the source code, algorithms, or calculation logic of the Platform
- Use automated scripts, bots, or scraping tools to access or extract data from the Platform
- Upload malicious files, viruses, or harmful code to the vault or any other part of the Platform
- Impersonate another person or misrepresent your identity or family information for fraudulent purposes
- Use the ORIS AI advisory for purposes unrelated to estate planning
- Violate any applicable Indian law or regulation while using the Platform
6. Intellectual Property
6.1 Our Property
The Wasiyat platform, including its software, algorithms, calculation engines, user interface, design, logos, trademarks, documentation, and all associated intellectual property, is owned by Wasiyat and protected under applicable Indian and international intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Platform for personal estate planning purposes.
6.2 Your Data
You retain full ownership of all personal data, family information, financial records, documents, and content you provide to or create within the Platform. We do not claim any ownership rights over your data. You grant us a limited license to process your data solely for the purpose of providing the services described in these Terms.
7. Disclaimers
IMPORTANT — PLEASE READ CAREFULLY
- Wasiyat is an educational and planning tool. It does NOT provide legal advice, and its output does NOT constitute legal counsel
- The Platform does NOT issue fatwas (Islamic legal rulings). All calculations and advisory outputs are based on published scholarly interpretations and are for informational and educational guidance only
- You should always consult a qualified estate lawyer in your state and a qualified Shariah scholar for your specific doctrine before acting on any information provided by the Platform
- The ORIS AI advisory feature provides informational responses only. AI-generated content may contain inaccuracies and should not be relied upon as the sole basis for estate planning decisions
- The Platform does NOT guarantee the legal validity or enforceability of any generated documents
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Please refer to our Disclaimer for full details on the limitations of our services.
8. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- Wasiyat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
- Our total aggregate liability for any claims arising from or related to these Terms or the Platform shall not exceed the total subscription fees paid by you during the 12 months immediately preceding the event giving rise to the claim
- We shall not be liable for any losses arising from reliance on the Platform's calculations, AI advisory outputs, or generated documents without independent professional verification
- We shall not be liable for any disputes arising among heirs, family members, or third parties regarding inheritance distributions
9. Indemnification
You agree to indemnify, defend, and hold harmless Wasiyat, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any dispute among heirs or family members arising from estate planning activities conducted on the Platform.
10. Governing Law & Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of India
- Any disputes arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India
- Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days
11. Modifications to Terms
- We reserve the right to modify these Terms at any time. Material changes will be communicated via email and a prominent notice on the Platform at least 30 days before they take effect
- Non-material changes (e.g., formatting, typographical corrections) may be made without prior notice
- Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms
- If you do not agree with the modified Terms, you may cancel your subscription before the changes take effect
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting us or through your account settings. Upon termination, you will have 30 days to export your data (family records, calculations, vault items, and generated documents) before it is permanently deleted.
12.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these Terms or our Acceptable Use policies
- Engage in fraudulent or illegal activities on the Platform
- Fail to pay subscription fees after reasonable notice
In the event of termination by us, you will be provided 30 days to export your data unless the termination is due to illegal activity.
12.3 Effect of Termination
- All rights granted to you under these Terms will immediately cease upon termination
- Sections 6 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 10 (Governing Law) shall survive termination
